Terms of Service

By accessing or using RescuePay ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms apply to all users, including businesses and their representatives.

RescuePay is an AI-powered payment recovery platform. We connect to your payment processor (e.g. Stripe), detect failed subscription payments, and automatically re-engage your customers via WhatsApp, SMS, and email to recover the revenue. You only pay when we successfully recover a payment.

To use RescuePay you must:

• Be at least 18 years old.
• Operate a legitimate business with a valid subscription product.
• Have the authority to enter into this agreement on behalf of your organisation.
• Comply with all applicable laws, including consumer protection and messaging regulations in your jurisdiction.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@rescuepay.io if you suspect unauthorised access. We reserve the right to suspend accounts showing signs of abuse or policy violations.

RescuePay operates on a success-fee model: you are charged a percentage of each payment we successfully recover, as specified in your plan. Additional platform fees may apply depending on your subscription tier.

Fees are billed monthly. Disputed charges must be raised within 30 days of the invoice date. We reserve the right to adjust pricing with 30 days' notice.

You agree not to use the Service to:

• Send unsolicited or deceptive communications to your customers.
• Recover payments for illegal goods or services.
• Violate any applicable messaging regulations (e.g. TCPA, GDPR, CAN-SPAM).
• Attempt to reverse-engineer, scrape, or copy the platform.
• Resell or sublicense access to the Service without written consent.

All software, algorithms, and content comprising the RescuePay platform are the exclusive property of RescuePay and its licensors. These Terms do not grant you any ownership rights — only a limited, non-exclusive licence to use the Service for your internal business purposes.

To the maximum extent permitted by law, RescuePay shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability for any claim shall not exceed the fees you paid in the 3 months preceding the event giving rise to the claim.

Either party may terminate the agreement with 30 days' written notice. We may terminate immediately upon material breach of these Terms. Upon termination, your access to the Service will cease and any outstanding fees will become immediately due.

These Terms are governed by the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.

We reserve the right to update these Terms at any time. We will provide at least 14 days' notice of material changes via email. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
